Terms of Service

1. Acceptance of these Terms

By accessing or using GetRadio PH (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

If you use the Service on behalf of a station, company, or other organization, you confirm that you have authority to accept these Terms for that organization.

2. The Service

GetRadio PH, operated by Broadtek Media Co. (“GetRadio,” “we,” “us,” or “our”), helps listeners discover and play online radio stations. Features may include station listings, stream playback, station information, artwork, metadata, installable web apps, and related support tools.

We may add, change, limit, or discontinue features at any time. Some features may differ by station, device, browser, location, or network.

3. Radio streams and third-party content

Most audio streams, programs, logos, station names, artwork, metadata, websites, and other station materials are supplied or controlled by independent station operators or other third parties. GetRadio does not produce, edit, or control that content unless we clearly state otherwise.

• A listing does not mean that GetRadio endorses a station or its programming.
• Station operators are responsible for their broadcasts, content, permissions, and stream availability.
• Playback may connect directly to a station stream or use a technical relay when needed to make a compatible stream available.
• Your mobile carrier or internet provider may charge you for the data used while listening.

If you hear or see content that may be unlawful, infringing, or inappropriate, contact the station operator when possible and notify us using the process in Section 7.

4. Acceptable use

We grant you a limited, non-exclusive, non-transferable, and revocable permission to use the Service for lawful personal or internal business purposes. You must not:

• use the Service in violation of any applicable law or another person’s rights;
• interfere with, overload, disrupt, damage, or attempt to gain unauthorized access to the Service or its systems;
• bypass access controls, security measures, playback restrictions, or technical limits;
• use automated tools to scrape, copy, index, or send excessive requests without our written permission;
• introduce malware or other harmful code; or
• copy, repackage, resell, or commercially exploit the Service itself without our written permission.

5. Station submissions and listings

If you submit, claim, or manage a station listing, you confirm that the information is accurate, that you are authorized to act for the station, and that you have all rights and permissions needed for the submitted stream, name, logo, artwork, metadata, and other materials.

You grant GetRadio a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, resize, display, and use those submitted materials only as reasonably necessary to list, promote, support, and provide the station through the Service. You retain ownership of your materials.

We may correct, refuse, suspend, or remove a listing that is inaccurate, unavailable, unsafe, unlawful, infringing, or inconsistent with these Terms. Station representatives may request an update or removal by contacting us.

6. Intellectual property

The Service’s software, interface, design, original text, GetRadio name, and GetRadio branding are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of them to you.

Third-party station names, logos, broadcasts, music, programs, and other materials remain the property of their respective owners.

7. Copyright and other rights concerns

To report material on GetRadio that you believe infringes copyright, trademark, privacy, or another legal right, email developer@getradio.ph and include:

• your name and contact information;
• a description of the protected work or right;
• the station name and exact GetRadio page or material at issue;
• why you believe the use is unauthorized; and
• a statement that the information in your notice is accurate and that you are the rights holder or authorized to act for the rights holder.

We may ask for more information and may remove or restrict material while reviewing a report.

8. Privacy

Our Privacy Policy explains how information is handled when you use the Service. Your browser or installed station web app may also store local preferences, cached files, or settings needed for features such as themes, playback, and faster loading.

9. Availability, updates, and compatibility

We try to keep the Service and listed streams available, but uninterrupted or error-free operation is not guaranteed. A station may change or stop its stream without notice. Playback can also be affected by third-party servers, browser rules, device settings, internet connectivity, geographic restrictions, maintenance, or events outside our control.

Installed web apps and cached pages may need to reconnect to GetRadio to receive updated station information, stream links, or software.

10. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant the accuracy, legality, quality, or availability of third-party streams or content.

Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, GetRadio and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or use arising from the Service or third-party content.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

12. Suspension and termination

You may stop using the Service at any time. We may suspend, restrict, or terminate access to all or part of the Service when reasonably necessary to protect users, stations, rights holders, our systems, or third parties; to comply with law; or to address a breach of these Terms.

13. Changes to these Terms

We may update these Terms to reflect changes to the Service, our practices, or applicable requirements. The “Last updated” date shows when the latest version took effect. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be submitted to a court of competent jurisdiction in the Philippines, subject to any mandatory rights available under applicable law.
